Legislative Instrument- F2019L00551 – Migration Amendment (Temporary Sponsored Parent Visa and Other Measures) Regulations 2019 defines a new Temporary Sponsored Parent (TSPV) visa and new class of sponsor; The Parent Sponsor. Australian citizens and permanent residents will now be able to sponsor their parents to stay in Australia on a temporary basis.

This visa will be limited to 15,000 visas per year and is not a transition to permanent residency. The total cumulative stay allowed is 10 years. During this period, parents shall not be entitled to depart.  Condition 8103 – ‘no work’ will be applied to the visa.

In order to be able to apply for this visa, The Parent Sponsor must be the child of the parent and must be an Australian citizen or permanent resident. The sponsor can only sponsor 2 parents at a time, and to do so, must have a minimum household income of $83,454.80, and have no debts to the Commonwealth or outstanding public health debts. The sponsor must be approved before the visa application can be lodged.

The sponsored parent must have genuine access to funds sufficient to fund their intended stay in Australia (we note that the cost has not yet been specified), and will be required to maintain adequate health insurance for the duration of their stay in Australia. Application charges will be as follows:

  • Sponsorship – $420
  • Three year validity visa – $5000, with first instalment $1,000 and second instalment prior to visa grant of $4,000
  • Five year validity – $10,000, with first instalment $1,000 and second instalment prior to visa grant of $9,000

As mentioned above, this visa cannot be used as a pathway to permanent residence and accordingly, holders or previous holders of this visa who have not departed Australia will not be eligible to apply for the following visas:

Parent – Class AX

  • Aged Parent – Class BP
  • Contributory Parent – Class CA
  • Contributory Aged Parent – Class DG
  • Contributory Parent (Temporary) – Class UT

This Instrument will commence on 17 April 2019.
